Die vZTA ist eine amtliche Entscheidung der EU-Zollbehörde zur Einreihung von Waren. Sie gilt 3 Jahre und ist in allen EU-Mitgliedstaaten verbindlich.
Einreihung von Heißwasserkesseln (8402 20)
Die Unterposition 8402 20 der Kombinierten Nomenklatur umfasst Kessel zur Erzeugung von überhitztem Wasser. Überhitztes Wasser ist Wasser, das unter Druck über seinen Siedepunkt bei Atmosphärendruck erhitzt wird, aber durch den erhöhten Druck im geschlossenen Kreislauf im flüssigen Zustand gehalten wird. Typische Parameter sind Temperaturen von 110-200°C bei Drücken von 6-25 bar. Diese Kessel werden in Fernwärmesystemen, industriellen Prozessen, die Hochtemperatur-Heizwasser erfordern, sowie in Trocknungs- und Pasteurisierungsanlagen eingesetzt. Das entscheidende Einreihungskriterium zur Unterscheidung von Dampfkesseln (8402 11/12/19) ist das Arbeitsmedium: überhitztes Wasser statt Dampf. Von Zentralheizungskesseln (Position 8403) werden sie durch die Betriebsparameter und die industrielle Anwendung unterschieden. Die Einreihung folgt den AV-Regeln 1 und 6 sowie den Anmerkungen zu Kapitel 84. Teile für diese Kessel werden in die Unterposition 8402 90 eingereiht.
PED-Anforderungen und Einfuhrvorschriften für Kessel 8402 20
Heißwasserkessel der Unterposition 8402 20 unterliegen als Druckgeräte der PED 2014/68/EU, da sie mit Wasser unter Druck über dem Siedepunkt arbeiten. Die PED-Risikokategorie hängt vom Betriebsdruck und Volumen ab. Überhitztes Wasser wird in der PED als Fluid der Gruppe 2 klassifiziert, und Kessel mit großen Volumina und Drücken werden in Kategorie III oder IV eingestuft. Die harmonisierten Normen EN 12952 (Wasserrohr) oder EN 12953 (Großwasserraum) gelten je nach Bauart. Die CE-Kennzeichnung ist obligatorisch. Die Einfuhr erfordert eine EORI-Nummer, Zollanmeldung, EU-Konformitätserklärung, Zertifikat der benannten Stelle und technische Unterlagen einschließlich Festigkeitsberechnungen, Druckprüfprotokollen und Werkstoffzeugnissen. Kessel für fossile Brennstoffe unterliegen den IED- oder MCP-Emissionsanforderungen. Die EMC-Richtlinie 2014/30/EU gilt für elektronische Steuerungssysteme.
Zollsätze und handelsrechtliche Aspekte der Unterposition 8402 20
Die MFN-Zollsätze für Heißwasserkessel der Unterposition 8402 20 sind in der TARIC-Datenbank der Europäischen Kommission zu prüfen. Diese Kessel sind Investitionsgüter, die hauptsächlich in der kommunalen und industriellen Wärmeversorgung eingesetzt werden. Wichtige Hersteller sind Unternehmen aus Deutschland, Dänemark, Finnland, Österreich und China. Präferenzielle Zollsätze können im Rahmen von FTA-Abkommen bei Erfüllung der Ursprungsregeln verfügbar sein. Erzeugnisse des Kapitels 84 unterliegen nicht dem CBAM-Mechanismus. Der Zollwert umfasst die Kosten für Kessel, Armaturen, Steuerungsautomatik und Sicherheitssysteme. Montage- und Inbetriebnahmekosten gehören nicht zum Zollwert, wenn sie im Vertrag gesondert ausgewiesen sind. Die Einfuhr aus Russland und Belarus unterliegt Sanktionsbeschränkungen. Was ist der Unterschied zwischen einem Heißwasserkessel und einem Dampfkessel?
Ein Heißwasserkessel (Unterposition 8402 20) erzeugt Wasser, das unter Druck über seinen Siedepunkt erhitzt, aber im flüssigen Zustand gehalten wird. Ein Dampfkessel (Unterpositionen 8402 11/12/19) erzeugt Dampf. Das Arbeitsmedium ist das entscheidende Einreihungskriterium. Überhitztes Wasser arbeitet in einem geschlossenen Druckkreislauf bei Temperaturen von 110-200°C und Drücken von 6-25 bar. Dampf wird in einem offenen oder geschlossenen System erzeugt und abgeleitet. Beide Kesseltypen unterliegen der PED 2014/68/EU.
Wie unterscheidet sich ein Kessel der Unterposition 8402 20 von einem Zentralheizungskessel 8403?
Ein Heißwasserkessel (8402 20) arbeitet bei Drücken und Temperaturen, die die normalen Gebäudeheizungsparameter deutlich übersteigen (über 110°C, 6 bar). Ein Zentralheizungskessel (Position 8403) ist ein Heizgerät für die Gebäudeheizung mit niedrigeren Parametern. Das Einreihungskriterium ist die industrielle Nutzung (Fernwärme, Prozesstechnik) gegenüber der Gebäudeheizung sowie die Druck- und Temperaturparameter. Kessel der Position 8402 20 unterliegen der PED in höheren Risikokategorien.
Welche Anwendungen haben Heißwasserkessel?
Heißwasserkessel werden in der kommunalen Fernwärmeversorgung zur Speisung von Wärmenetzen, in der Lebensmittelindustrie für Pasteurisierungs- und Sterilisationsprozesse, in der chemischen Industrie für die Prozesserwärmung, in der industriellen Trocknung und in Heizungssystemen großer öffentlicher Gebäude eingesetzt. Der Vorteil von überhitztem Wasser ist die Möglichkeit, Wärme über große Entfernungen ohne die mit der Dampfkondensation verbundenen Verluste zu transportieren. Typische Parameter sind 120-180°C und 10-16 bar.
