Definition and scope of subheading 8539 22
Subheading 8539 22 covers other incandescent filament lamps (non-halogen) with a power rating up to 200 W and voltage above 100 V. This includes traditional tungsten filament lamps in inert gas (argon, krypton) without halogen. The category formerly covered standard household A-shape lamps (E27), candle lamps (E14) and PAR reflectors. Most have been phased out under Ecodesign. Remaining types include decorative vintage-style lamps with exposed filaments, oven lamps and appliance lamps with specific thermal requirements.
Ecodesign phase-out of traditional incandescent lamps
Traditional incandescent lamps under 8539 22 were phased out from the EU market under Regulation (EU) 2019/2020 and earlier Ecodesign measures. From 2012, successive phase-outs removed 100 W, 75 W, 60 W and 40 W lamps. Import remains formally possible but sale as general lighting is prohibited. Exemptions cover specialist lamps defined in Annex V. RoHS 2 restricts hazardous substances. WEEE 2 covers collection. CBAM does not apply.
Duty rates for subheading 8539 22
MFN rates should be verified in TARIC. The traditional incandescent lamp market has virtually disappeared in the EU. Import focuses on specialist lamps. Preferential rates under FTAs. VAT is charged.
Filament lamps up to 200 W - EU Ecodesign rules
Importing filament lamps up to 200 W (CN 8539 22) into the European Union requires compliance with RoHS 2 (2011/65/EU), WEEE 2 (2012/19/EU) and CE marking. An EORI number and correct customs declaration are mandatory. MFN duty rates should be verified in TARIC, as ITA preferences or EU FTA rates (e.g. CETA, EPA, EU-Korea) may apply. Import from Russia and Belarus is subject to EU sanctions. Ecodesign Regulation (EU) 2019/2020 sets energy requirements for light sources. National import VAT applies at the destination Member State rate.

Can traditional incandescent lamps be imported into the EU?
Import is formally possible but sale of traditional incandescent lamps for general lighting is prohibited since 2012. Permitted categories include specialist lamps: oven lamps, refrigerator lamps, appliance lamps with specific thermal requirements, decorative vintage lamps and industrial lamps. Eligibility is verified against Annex V of Regulation (EU) 2019/2020.
How are vintage-style exposed-filament lamps classified?
Decorative vintage-style lamps with tungsten filaments and traditional E27 or E14 caps are classified under 8539 22 (up to 200 W) or 8539 29 (above 200 W). LED lamps imitating the vintage look (with LED filaments instead of tungsten) are classified under 8539 52 as LED lamps.
Are incandescent lamps subject to CBAM?
No. CBAM covers only emissions-intensive goods. Lamps under 8539 22 fall outside CBAM scope.
