- CD917By virtue of Article 4(6) of Regulation (EU) 2024/573, the placing on the market of fluorinated greenhouse gases shall be prohibited, unless importers provide evidence that any trifluoromethane, produced as a by-product during the production process of the fluorinated greenhouse gases has been destroyed or recovered for subsequent use, using best available techniques.By virtue of Article 11.1. of Regulation (EU) 2024/573, the placing on the market of products and equipment, including parts thereof, listed in Annex IV, with an exemption for military equipment, shall be prohibited from the date specified in that Annex.By virtue of Article 11.1 sub paragraph 2 (a)(b), (c) of Regulation (I) 2024/573, the placing on the market of parts of products and equipment required for repair and servicing of existing equipment listed in Annex IV shall be allowed. Einachsschlepper unter KN-Code 8701 10
Der KN-Code 8701 10 umfasst Einachsschlepper, also Maschinen mit einer angetriebenen Achse, die für den Betrieb mit austauschbaren Arbeitsgeräten konzipiert sind. Diese Schlepper werden von einem hinter der Maschine gehenden Bediener gesteuert und finden hauptsächlich in der Landwirtschaft, im Gartenbau und bei kleinen kommunalen Arbeiten Verwendung. Die Konstruktion basiert auf einem Verbrennungsmotor (meist ein Einzylinder-Diesel oder Benzinmotor) mit einer Leistung von wenigen bis etwa fünfzehn Kilowatt, einem mechanischen Getriebe und einer Zapfwelle zum Antrieb von Bodenfräsen, Mähern, Transportanhängern und anderen Anbaugeräten. Auf dem europäischen Markt müssen Einachsschlepper die Anforderungen der Maschinenverordnung (EU) 2023/1230 bezüglich der Betriebssicherheit erfüllen, und ihre Motoren unterliegen den Emissionsgrenzwerten der Verordnung (EU) 2016/1628 über Motoren in nicht für den Straßenverkehr bestimmten mobilen Maschinen. Die Einfuhr dieser Maschinen in die Europäische Union erfordert eine CE-Konformitätserklärung und eine technische Dokumentation, die die Einhaltung der geltenden Sicherheits- und Emissionsnormen bestätigt.
Zollrechtliche und regulatorische Anforderungen bei der Einfuhr
Bei der Zollabfertigung von Einachsschleppern unter dem KN-Code 8701 10 muss der Importeur eine Handelsrechnung, ein Transportdokument, eine Zollwertanmeldung und gegebenenfalls einen Ursprungsnachweis vorlegen, wenn Präferenzzollsätze aus EU-Handelsabkommen beansprucht werden. Aktuelle Zollsätze sind im TARIC-System oder im polnischen ISZTAR4-System zu überprüfen, da sie je nach Ursprungsland und geltenden Zollkontingenten variieren können. Die Mehrwertsteuer wird zum in Polen im Jahr 2026 geltenden Regelsatz berechnet. Bei der Einfuhr aus Nicht-EU-Ländern können zusätzlich phytosanitäre Formalitäten erforderlich sein, wenn der Schlepper in der Landwirtschaft eingesetzt wurde und möglicherweise mit Erde verunreinigt ist. Für statistische Zwecke ist bei innergemeinschaftlichem Erwerb oberhalb bestimmter Schwellenwerte eine INTRASTAT-Meldung erforderlich.
Anwendungen und Markt für Einachsschlepper
Einachsschlepper unter KN-Code 8701 10 stellen eine wirtschaftliche Lösung zur Mechanisierung von Arbeiten auf kleinen landwirtschaftlichen Betrieben, im Gartenbau, in Obstplantagen und Weinbergen dar, wo der Einsatz eines vollwertigen Zweiachsschleppers wirtschaftlich nicht gerechtfertigt oder aufgrund der Geländebedingungen nicht möglich ist. Dieser Markt zeichnet sich durch eine stabile Nachfrage seitens kleiner landwirtschaftlicher Betriebe in Süd- und Osteuropa aus. Bei der zolltariflichen Einreihung ist es wichtig, Einachsschlepper von Motorhacken und selbstfahrenden Bodenfräsen zu unterscheiden – entscheidend ist die Multifunktionalität des Einachsschleppers und seine Fähigkeit zum Anschluss verschiedener austauschbarer Arbeitsgeräte. Einachsschlepper müssen grundsätzlich nicht als Straßenfahrzeuge zugelassen werden, da sie von einem gehenden Bediener gesteuerte Maschinen sind. Eine Fahrzeug-Typgenehmigung nach der Verordnung (EU) 2018/858 ist daher nicht erforderlich. Sie müssen jedoch die Anforderungen der Maschinenverordnung (EU) 2023/1230 erfüllen und die CE-Kennzeichnung tragen. Für Modelle mit Transportanhänger zum Einsatz auf öffentlichen Straßen können zusätzliche nationale Vorschriften zur Beleuchtung und Kennzeichnung gelten.
Wie hoch ist der Zollsatz auf Einachsschlepper aus Nicht-EU-Ländern?
